What you do is go into the Dungeon Siege file in your hard drive, find the start application, right click it, go to properties, then compatibility, then check "Run in compatibility mode for:" Windows 7. I have Windows 8 as well, and I had similar problems, such as the game would just quit on me because of the compatibility problems.
